First, please note that I am not a lawyer and you should take the following with a grain of salt and read at your own risk. That means whatever I tell you here is what I personally experience. I just want to share my story in hopes of inspiring you all to take action.
Also, I am in no way saying you have to do what I do so I recommend you consult with a lawyer before you do any of the following. Read at your own risk!
Everyone loves starting a blog.
They love talking about blogging, but no one wants to talk about the truth about blogging. So, I am going to talk a bit regarding how to legally protect your blog in 2021.
What’s the number one blog that I’ve come across when I read other blogs?
How to start a blog.
This shouldn’t come as a surprise, right?
When bloggers sell the dream of starting a blog in as little as $2.75, or whatever that number is, and in as short as five minutes, of course, I was going to jump ship and climb aboard.
But…
No one actually talks about the truth. Like the legal truth about blogging. Specifically, the nit-picky stuff that people like me tend to worry about: how to protect your blog legally.
Did you know you every blog needs to have three pieces of legal documents? I will go more into detail below.
Bloggers want to sell the dream of starting a successful blog and leaving the 9-5 as fast as Thanos snapping his fingers.
The Legal Stuff that Nit-picky People Worries About
Bloggers tend to forget that there is a group of human beings like me who are super nit-picky.
These people always want to make sure they do the right thing, in the right step, and at the right time. In fact, they do this because they want to be as prepared as possible. No surprises.
So when these bloggers sell the dream of starting your blog as cheap as possible and as soon as possible…this raises red flags because nit-picky people like me wants to know:
- What do I need to actually create a blog?
- When do I create a post?
- How is a post different from a page?
- If I want to leave my 9-5, I need to make money. How do I make money?
- If I make money, don’t I need to register my blog?
- How do I register my business?
And yada yada yada. You get the point.
Bloggers make setting up a blog sounds like a breeze, but it’s really not. I mean, I’m taking advice from someone who has been blogging for a few years now.
They’re not going to remember the exact steps they took to launch their blog.
Or to slow down and explain things at a level that a newb like me could understand.
They’re going to skip the nit-picky details just as fast as they want to sell me the dream of starting my own blog and leaving my 9-5.
And that’s where I jump in.
I want to tell you about the legal truth about blogging—at least based on what I’ve experienced so far—which, frankly, I’ve only ever come across one blogger who mentioned this in her blog out of the 50+ blogs I’ve read.
Yikes.
The Legal Truth About Blogging
Did you know that every bloody website needs to have at least three pieces of legal documents to protect their blog?
See what I did there? I’ve always wanted to use that word like how Ron uses it in Harry Potter. Anyways, I digress.
They are a:
- Privacy Policy
- Disclaimer
- Terms and Conditions
Yeah, if you didn’t know this before, now you do.
What’s a Privacy Policy?
First, this document legally protects your blog by detailing how information from visitors is collected and used. For example, if a blogger collects emails from his or her users, the blogger would detail what he or she intends to do with that information in this legal document.
Check out my Privacy Policy here.
What’s a Disclaimer?
Next, this document legally protects your blog by detailing how a website is not responsible for anything should consumers (think people who visit a website) do anything with the content on the website and get into trouble or hurt themselves.
For example, I blog about finance, but I make sure my writers first and foremost that I am not a financial expert and they must use my content at their own risk.
Not sure what I mean? Scroll to the top of this blog post and read that paragraph in italics. Or check out my disclaimer here.
What are Terms and Conditions?
Last but not least, you can legally protect your blog with this document because it acts as a contract between me and the visitors of my website. It says that if you are on my website, you are agreeing to the terms and conditions I set forth on my website.
Not sure what I mean? Check out Terms and Conditions on my blog here.
By the way, if you’re thinking that you can just copy and paste people’s legal documents and use it on your own—don’t.
That’s against the law and you can get sued.
I’m not a lawyer, so why should you trust me?
You don’t. That’s why I added that disclaimer on top.
I am not a legal advisor or a lawyer, but I am writing this out of the kindness of my heart so you’re aware of the legal implications that often come with running a blog so you can be prepared.
So, What Do I Do to Protect My Blog Legally?
Great question.
The answer is simple:
- Hire a lawyer to create these three documents that will legally protect your blog.
